A Pennsylvania judge ruled that Sherri Shepherd is still obligated to pay her ex-husband Lamar Sally child support for a child the couple had via a surrogate. L.J. was born in August 2014, and Shepherd has been battling the courts since his birth over the fact that she didnโ€™t feel obligated to pay her ex support.

On Monday theย Pennsylvania Supreme Court declined to hear Shepherdโ€™s appeal after a lower court determined that she was the childโ€™s legal mother and ordered her to pay child support in November. The baby was born using Sallyโ€™s sperm and a donorโ€™s egg. Shepherd had contended that her and Sallyโ€™s marriage was a fraud and thus she shouldnโ€™t be held responsible for the baby.

In November, when Shepherd lost her first appeal, Sally expressed his happiness.

โ€œIโ€™m glad itโ€™s finally over,โ€ย Sally told People magazine. โ€œIโ€™m glad the judges saw through all the lies that she put out there, and the negative media attention. If she wonโ€™t be there for L.J. emotionally, Iโ€™ll be parent enough for the both of us.โ€ย 

Shepherd is now obligated to continue her payment of $4,100 a month to Sally.
