In July a Jane Doe filed a $10 million lawsuit against Usher, claiming that he exposed her to herpes, after it was revealed the singer settled a $1 million lawsuit with a woman who said he infected her with herpes.

Shortly after filing the initial lawsuit, the anonymous woman upped the ante to $20 million after, she says, she found out she was indeed infected with the virus.

On Thursday, Usher’s legal team issued a response to the lawsuit, stating there’s no way to prove he gave her the virus. According to TMZ, Usher is asking a Georgia judge to throw out the lawsuit on the basis that the woman easily could have been infected before having sex with Usher, or even after, and that she put herself at risk when engaging in “casual, unprotected sexual intercourse and/or oral sex.”

The response didn’t indicate that the lack of proof comes from his not having herpes.
