A registered sex offender who pleaded no contest to felony assault and was sentenced to a year in jail sued his victim for defamation of character in a California court.

Lang Her, 26, sued Yee Xiong, 24, on the day he was sentenced to one year in jail for assaulting Xiong after a party at his house, the Sacramento Bee reports. Her was angry that Xiong and her siblings had been posting about him on Facebook, calling him a rapist. ย
Her and Xiong are former University of California, Davis students who grew up together in Marysville, Calif. Their families know each other.
Xiong told police that on July 9, 2012, she went to a party at Herโs off-campus apartment. After drinking too much, she fell asleep in one of the bedrooms. She awoke before dawn to find her arms pinned to her side, and Her having sex with her.
After two trials ended in hung juries, Her pleaded no contest to felony assault in July. He was sentenced to one year in jail, required to register as a sex offender and ordered to receive sex-offender counseling for the entirety of his five-year probation.
On the day of the sentencing, Herโs sister delivered the lawsuit to Xiong. In his complaint, Her claimed that Xiongโs sister made โfalse and defamatoryโ statements about him on Facebook.
One post, written by Ger Xiong and shared by Yee Xiong and two other siblings, read, โWe will not be silenced. We will fight for justice against Lang Her, who is a rapist.โ
On Monday a Yuba County, Calif., judge dismissed the lawsuit in 15 minutes, the Daily Dot reports.
Ger Xiong responded with a triumphant post on Facebook.
