Despite his October sentencing date, Sean “Diddy” Combs is trying his best to get out of prison as soon as he can. In his latest attempt, Diddy and his legal team have filed a new motion for his early release.

Diddy is facing a maximum 20 years behind bars after being found guilty for each of his two counts of prostitution, we previously reported. The disgraced mogul was found not guilty on the harsher charges of racketeering, so according to his team, he should be released. “There has literally never been a case like this one,” Diddy’s lawyers said referring to the Mann Act, which the rapper was convicted of violating.
The Mann Act essentially made it illegal to transport women across state lines for prostitution or any other “immoral” purpose. With this, his team claims Diddy is simply a participant in the “swingers” lifestyle– where couples invite others into their sexual relationship. This, as told by Diddy’s team, is not a crime.
In the filing obtained by The Root, Diddy’s team noted, “Cassie Ventura and Sean Combs went to swingers clubs and they had threesomes. Ms. Ventura consistently expressed interest and enthusiasm in her intimate life with Combs, including what they called ‘freak offs,’” referring to the elaborate and reportedly physically draining sexual performance put on by Diddy and his previous girlfriends. “Jane and Sean Combs had threesomes too.”
The judge in Diddy’s case, Arun Subramanian, has repeatedly denied all motions to grant Diddy an early release. Largely, Judge Subramanian’s ruling takes into account Diddy’s access to resources which could make him a danger to the community. During his trial, Diddy’s team acknowledged his violent past, citing the 55-year-old has undergone therapy and has taken domestic violence classes.
As it now stands, Diddy’s proposed bail includes a $50 million bond from Diddy’s Florida estate three “financially responsible people.” Additionally, Diddy’s attorneys said he would live at his Miami home and wouldn’t leave Florida– unless it’s for his criminal sentencing in New York. He also promises to surrender his passport, similar to previous motions to grant bail.
“If released on conditions, Sean Combs will not be violent to anyone,” Diddy’s team said. “As we said in court, this jury gave him his life back, and he will not squander his second chance at life, nor would he do anything to further jeopardize his seven children not having a father.” Now, we wait for the judge to rule…
