Erica Renee Sanders and her boyfriend, Keven Dwayne Adams, had mentioned how they would be relocating at some point, Law & Crime reported. But it seems the pair didn’t tell her 12-year-old son about said plans.

On Oct. 17, police in Copperas Cove, a city about 140 miles north of San Antonio, responded to a call at an apartment complex off Primrose Drive around 5:20 p.m. about a young boy who returned home to an empty apartment and his family no where to be found. An arrest affidavit, obtained by local news channel KWKT, says the boy went to his neighbor’s house and showed them the empty apartment.

When the couple was contacted by police via phone, Adams said his girlfriend didn’t abandon the boy — she simply moved in with him and admitted her son wasn’t welcome at his home. They also told authorities that the boy’s uncle was going to pick him up.

The problem with that was they failed to provide said uncle’s contact information, and when police found it themselves, the uncle said he had no idea about the arrangement.

Fox 8 Alive reported that the pair also told police the boy’s older brother was supposed to pick him up after school, but an affidavit states when officers eventually tracked down the older brother, he was unaware he was supposed to do so.

Adams reportedly told police how he had “complained at length” about his girlfriend’s 12-year-old son, whom he is accused of leaving to fend for himself. A neighbor, per the outlet, told police the couple had a history of kicking the boy out.

After several hours, the boy’s uncle, Sanders’ brother, eventually came to pick him up, but police still contacted Child Protective Services, who said the couple refused to provide their new address. It was only discovered after detectives searched water utility records to find Adams’ home address.

Adams and Sanders were both charged with abandoning or endangering a child without intent to return– a third-degree felony. If convicted, they face up to 10 years in state prison and a $10,000 fine.
