The Georgia couple who claimed their baby was decapitated during birth filed a suit not only against the doctors but also the man who conducted the autopsy after discovering he shared photos of the child's corpse on Instagram. Now, they finally got justice.

Independent pathologist Dr. Jackson Gates and Gates Rapid Diagnostic Laboratory of Atlanta were sued in September 2023 for allegedly uploading a video of his autopsy of little Treveon Isaiah Taylor Jr. on social media - and without permission. The child's parents, Jessica Ross and Treveon Isaiah Taylor Sr., claimed the multiple videos exposed the child's severed head and some of his exposed organs.

Gates bit back at the accusations, asserting that he did not reveal the identity of the child.

โ€œI have not violated HIPAA, it is not required by a physician to get consent to report a crime or some sort of health issue to the public. Iโ€™ve been doing this for 15 years, publishing my autopsy cases to explain to the public the victimization of those persons who have died," Gates said at the time.

Nonetheless, a jury decided he was in the wrong and awarded the Georgia couple a whopping $2.25 million in damages, per WWYN.

The Source of The Lawsuit

Just a month after Ross and Taylor filed a lawsuit alleging that a doctor at Southern Regional Medical Center in Riverdale, Ga. was responsible for the death of their baby, the couple is filing a second lawsuit against the physician who performed the autopsy after they saw videos of the procedure posted on social media.

Allegedly, the couple went to Gates for an independent autopsy after the funeral home discovered that their baby, Isaiah, was decapitated, according to WSB-TV.

Meant to only perform an autopsy, family members notified the couple that Gates posted photos of the babyโ€™s head on his Instagram profile along with his exposed organs. Although the initial post was deleted, the suit claims that two more videos from the autopsy were posted days later to his Instagram page with the caption, โ€œthe autopsy of the chest cavity of the child and the cranial cavity of the child.โ€

Gates claims that he posts photos and videos of multiple autopsies he performs on his social media and says that itโ€™s only for โ€œeducational purpose.โ€

In their initial lawsuit, the couple named Dr. Tracey St. Julian as the person responsible for the babyโ€™s death at the Georgia hospital after hours of unsuccessfully attempting to deliver the baby.

Specifically, the lawsuit says Baby Isaiahโ€™s shoulders got stuck in the vaginal canal, causing the delivery to be halted. After three hours of trying to get the baby out, the couple asked for a C-section to be performed, but they were denied.

They then said St. Julian used โ€œridiculously excessive forceโ€ on the babyโ€™s head when she tried to pull him out, but it did not work. When a C-section was finally attempted, it showed that the childโ€™s heart had stopped.

More from USA Today:

This was when the babyโ€™s torso and legs were delivered surgically while the head was delivered vaginally, alleges the suit. The hospital is accused of then wrapping the baby tightly in a blanket and โ€œpropping the babyโ€™s head on top of the blanket to make it appear like the head was attached when it wasnโ€™t,โ€ Edmond previously told reporters at an August press conference.

While the lawsuit is also claiming that Southern Regional Medical Center attempted to cover up the babyโ€™s death, they also arenโ€™t protecting Dr. St. Julien, who they say โ€œis not and never has been an employee of the hospital.โ€
