Just days after the family of a 13-year-old Oakland, Calif., girl petitioned the courts to have an Alameda County judge declare the teen alive, the family’s lawyer released a video clip showing her responding to verbal commands.

In video released Friday, Nailah Winkfield, the mother of Jahi McMath, asks her daughter to move her hand, and Jahi moves her right hand. In another clip the mother asks Jahi to move a foot, which she does after some verbal encouragement. “I always knew ’cause I’m her mother, and I talk to Jahi, she responds, so I said, ‘She can’t be brain-dead if she’s responding,’” Winkfield said, according to ABC 7 Los Angeles.
Family members gathered Friday at the office of Christopher Dolan, their attorney, to release the video, arguing that Jahi is not brain-dead, the television station reports.
“There’s a difference between being brain-damaged and … being brain-dead,” Dolan said, according to ABC 7.
